Key Terms and Definitions

POENB has a set of six Rules and Policies. Each of these documents is posted on POENB’s website (www.eatonsneck.org).

This document, called Key Terms and Definitions, is part of this set of seven Rules and Policies.

The Key terms and Definitions are listed in alphabetical order and provide clear, consistent, and agreed upon meanings for words that are routinely used throughout the POENB Rules and Policies. Key Terms also expedite communication and prevent misunderstandings. Finally, a consolidated list of Key Terms and Definitions makes it faster and easier, administratively, to update information.

Members and other interested parties are encouraged to carefully read the POENB Key Terms and Definitions and related Rules and Policies to have a comprehensive understanding of POENB’s management practices.

POENB’s Key Terms and Definitions and Rules and Policies may be modified, updated or rescinded to adapt to new legal requirements, strategic goals and/or operational needs. Typically, the Board evaluates the POENB’s Rules and Policies on an annual basis. However, in selected cases, POENB may need to modify the Rules and Policies during a given year to properly manage the Beach Properties for the benefit and safety of the Members. Changes to these Rules and Policies are permitted based on a simple majority vote by the Board of Directors.

The Board will communicate to Members material changes to the Rules and Policies during the Member Meetings and/or via emails or announcements on social media.

An Appendix to the Key Terms and Definitions contains a Version Control Table that identifies the name, version, and “as of” date for the Key Terms and the Member who made the changes. It also identifies the Board Member (by Title) who is responsible for ensuring (1) the accuracy, completeness, currency, and reasonableness of the Key Terms on a go-forward basis, and (2) the intellectual consistency of the Key Terms with related POENB Rules and Policies.

  1. Abandoned Craft – are watercraft that (1) are unmarked / lack indicators that would identify the owner of the vessel, or (2) are marked / the owner is known, but despite repeated attempts to contact the owner using various communication methods, the owner has been unresponsive for more than 90 days. Abandoned craft will be sold, if possible, with proceeds going to POENB’s general fund or abandoned craft will be discarded.
  2. Access Point – is a designated location, such as a pathway or driveway, which provides ingress and egress between a private property and a public roadway. Ingress and egress refer to the legal right to enter (ingress) and exit (egress) private property.
    At Price’s Bend, there are two types of Access Points: (1) POENB Member Access Points and (2) Resident Non-Member Property Owner (“RNMPO”) Access Point.

There are three POENB Member Access Points at Price’s Bend: (1) the driveway (which includes a physical barrier for vehicles – the Security Gate), (2) an opening in the shrubbery near the Shed for pedestrians to walk onto the Beach Property, and (3) latched gate with a lattice work archway pedestrian path near the Playground equipment.

There is only one Access Point at Valley Grove. Given the size of the property, both POENB Members and RNMPO enter from Westview Road using a paved pedestrian path.

  1. Approved Watercraft – are watercraft or sail craft meeting two POENB determined criteria: (1) type and (2) size. Details on the type and size of Approved Watercraft are found in the Watercraft Rules – Section 3. Only Approved Watercraft may be stored at Price’s Bend or Valley Grove by a POENB Member in Good Standing.
  2. Assigned Watercraft Storage Spot – (sometimes called Assigned Spot Number) is a specific location (identified by the beach name and a letter and a number, PB K-3) at one of the watercraft racks or sail craft beach spots at Price’s Bend or at one of the watercraft racks at Valley Grove that has been assigned to a Member for their exclusive use for a 2 year period. All Members with an Assigned Watercraft Storage Spot must follow all POENB Watercraft rules.
  3. Association – refers to and is synonymous with the term POENB, Inc.
  4. Attendee – one benefit of POENB membership is the ability of a Member to reserve Price’s Bend for a private, non-commercial use party or event. Individuals who are invited to and then attend a private party hosted by POENB Member at POENB’s Price’s Bend Beach Property are called “Attendees.” Attendees are allowed access to designated sections of Price’s Bend for the duration of the Beach Party/Event.

To be clear, invitees are individuals who receive an invitation to a party/event but may or may not attend. They are potential attendees.

Invited attendees are people who were invited, accepted the invitation (e.g., confirmed or registered their intent to attend the party/event with the Member/Host), and then attended the Beach Party/Event.

“Invited attendee” is a redundant term. It is synonymous with Attendee and is not a POENB Key Term. POENB assumes that all Beach Party/Event Attendees were invited.

A person who attends a Beach Party/Event sponsored by POENB Member/Host but were not invited, are considered trespassers.

As documented in the Beach Party/Event Rules, the Member/Host of a Beach Party/Event does NOT have exclusive use of the entire Beach Property. The Member/Host must confine their Beach Party/Event activities to designated areas communicated by the POENB Board.

Therefore, Members using a non-Beach Party/Event designated space of at Price’s Bend or Resident Non-Member Property Owners using the designated Easement Area are not considered trespassers.

  1. Authorized Vendor – is a third-party business that POENB, Inc. has contracted with to perform routine beach preservation, maintenance and improvement services. When selecting its Authorized Vendors, POENB’s Board adheres to contracting better practices such as (1) clear, written objectives and performance standards and measurable outcomes, (2) standardized terms and conditions templates, (3) quotes from at least three vendors to ensure scope and project objective understanding and pricing schemes, (4) financial, legal (insurance and licensing) and operational due diligence on selected vendors, and (5) routine communication to monitor performance and satisfaction.
    Authorized Vendors are asked to provide a security deposit for their Clickers so they can enter Price’s Bend and complete their work. POENB allows Authorized Vendors to have a maximum of TWO Clickers.
  2. Beach Amenities – are amenities available to Full and Limited Members In Good Standing and their Household. These amenities are included in the price of an annual membership and are available at both Beach Properties unless otherwise noted.
    A. Access to and use of the entirety of the POENB, Inc.’s two Beach Properties (Price’s Bend and Valley Grove) for bathing, boating and recreational purposes, including the “Easement Area” designated for Resident Non-Member Property Owners, but not including (except for) environmentally protected parts of the beaches (wetlands, salt marshes and critical habitats) which is typically designated by POENB, TOH, or NYS signage
    B. Picnic tables and benches.
    C. Umbrellas upon request and advance notice (Price’s Bend only)
    D. Garbage cans
    E. Dumpster (PB only)
    F. Portable Toilet (PB only)
    G. Charcoal grills
    H. Shower/washing facility.
    I. Wi-Fi (PB only)
    J. Playground equipment
    K. Swim area marked by swim lines (PB only)
  3. Beach Operating Hours – During the Beach Season, POENB’s two beaches are open from 8:00 AM to 9:00 PM. During the non-beach season, the beaches are open from sunrise to sunset. See Beach Party / Event Rules for the operating hours for a Beach Party / Event.
  4. Beach Party / Event – refers to a private, non-commercial use beach party/event hosted by a Member in Good Standing and held at Price’s Bend ONLY. A Member cannot sponsor a beach party/event at Valley Grove.
    The Beach Party/Event is considered private because (1) it is not sponsored by POENB, Inc. and (2) it is not open to the general public. It is an invitation-only event. Private, invitation-only parties and events often include (1) personal celebrations (e.g., birthdays, anniversaries, promotions) and (2) civic, social and community get-togethers (e.g., scouting, sports teams, clubs or religious groups).
    As described in Section 8 of the Beach Rules, a private, invitation-only party or event must not include any Commercial Activities.
    A. A Member/Host cannot reserve and use the Price’s Bend to “sell” products or services, provide lessons, or give a musical, theatrical, or dance recital or performances – that are privately underwritten.
    B. Selling is defined in the broadest sense possible and includes receiving cash, accepting donations or making like-kind exchanges.
    C. POENB, Inc., as the owner of the Beach Properties, has Commercial Use insurance ONLY for events that it sponsors.
  5. Beach Properties – refer to the two POENB, Inc. owned beach properties: (1) Price’s Bend and (2) Valley Grove. Price’s Bend runs along Birmingham Drive and overlooks Northport Bay. Valley Grove runs along Westview Road and overlooks Long Island Sound. The total acreage of both beaches is ~2.2 acres.
    Based on the Town of Huntington tax rolls, the POENB Area consists of 409 separate property lots. Price’s Bend is considered one lot while Valley Grove consists of two lots. The three other lots comprising the 409 lots are for the Suffolk County Water Authority (1 lot) and the Eaton’s Neck Fire Department (2 lots).

Four hundred and three (403) of the total 409 lots are zoned for single family, residential housing.

  1. Beach Season – refers to POENB’s “peak” beach season which runs from Memorial Day to Labor Day.
  2. Blackout Dates – are dates reserved for POENB sponsored parties and events. The Association always has priority over Members with respect to usage of the Beach Properties. The Board identifies these “blackout dates” at the beginning of each calendar year. Historically, Blackout Dates have included either Palm Sunday or the day before Easter (for the Easter Egg Hunt), the Memorial Day Weekend, and the 4th of July.
  3. Board of Directors – also called “the Board,” “the POENB Board.” Refers to the Officers of the Association as outlined in Article VI of the By-Laws of the Property Owners of Eaton’s Neck Beach, Inc. The seven Officers on the Board of Directors include the President, Vice President, two Assistant Vice Presidents, Corresponding Secretary, Recording Secretary and Treasurer.
  4. Clicker – is a highly reliable, small, plastic handheld device, formally known as a gate remote control or a transmitter, which is used to open and close a security gate remotely. When a person presses an open or close button on the remote, the device “clicks.” Hence the name “clicker.”
    POENB installed a security gate at Price’s Bend in 2025. A Member needs a Clicker to drive his/her vehicle through this security gate.

A Clicker is not a condition of membership POENB. A member does not need to put a security deposit down for a Clicker and simply checks “no Clicker needed” on the membership application form. If, however, a Member later decides that he /she would like the option of driving into Price’s Bend and parking in the lot, the Member may order a Clicker, by notifying the Board and providing a one-time security deposit.

The Gate Rules and the Security and Data Policies, two documents included in POENB’s set of seven Rules and Policies, provide additional information on gate operations and data collected.

  1. Committee Chair – Per Article X of the By-Laws, POENB has five permanent committees: (1) Membership, (2) Beach, (3) Planning and Zoning, (4) Social Activities, and (5) Nominating. The President and/or the majority of the Board of Directors may also create special committees as they deem necessary. Members of the Board of Directors cannot be chairman of any committee. In selected cases, if there are no or an insufficient number of committee volunteers, the President will appoint a Board Member to take over committee duties.
  2. Designated Beach Party/Event Usage Area – At Price’s Bend, Beach Parties/Events are confined to the area around the picnic tables to the right of the vehicle entrance. The Designated Beach Party/ Event Area does not extend to the playground or the two watercraft / dinghy racks (near Worchester Court and between Tudor and Argyle Drive).
  3. Designated Easement Usage Area – is an area of Price’s Bend which has been identified by POENB, Inc. as a suitable location to provide “reasonable accommodation” for Resident Non-Member Property Owners (RNMPO) to the beach and the water. The Designated Easement Usage Area at Price’s Bend is clearly marked with signs.
    At Price’s Bend, the Access Point is a pedestrian footpath, located off Birmingham Drive. It is approximately midway between Tudor Drive and Argyle Drive but closer to Argle Drive. The ingress and egress spots are clearly identified with a sign reading “Easement Entrance.”

The Designated Easement Usage Area is directly in front of the RNMPO Access Point and pedestrian path and is clearly marked with signs.

The Designated RNMPO Usage Area is a subset of the Price’s Bend Beach.

While RNMPO must confine their enjoyment of bathing and recreational activities (as identified in the 1960 Indenture Agreement between ENSC and POENB), POENB Members enjoy unfettered access to all parts of Price’s Bend – unless off-limits given environmental concerns (protected flora and fauna/wetlands).

Because Valley Grove is significantly smaller in acreage than Price’s Bend, it is not practical to designate a Usage Area without negatively impacting Members.

As a result, Access and Usage space at Valley Grove must be shared between Members and RNMPOs.

  1. Designated Watercraft Storage Locations – are the specific locations or areas on the POENB Beach properties where watercraft racks and or spaces on the beaches where craft can be stored.
  2. Easement – is a legal right that grants all POENB Area property owners the right to access and use the two beaches under certain restrictions, conditions and limitations set by POENB, Inc.
    On August 30, 1960, Eaton’s Neck Sound Corporation (“ENSC”), the original developer of the POENB Area, and POENB, Inc signed an indenture agreement. This document is a public record, filed as Liber 4915, page 569, at the Suffolk County Clerk’s Office in Riverhead, NY.
    In plain language, this document:
    • Transfers ownership of the three lots (two at Valley Grove and one at Price’s Bend) from ENSC to POENB, Inc.
    • Includes a promise that POENB, Inc (or its successors) will keep these areas, dedicated as recreational spaces for all current and future owners of lots or land within the POENB Area boundaries; and
    • Requires that POENB, Inc. maintain these beaches in good condition for recreational use.
    The Indenture also contains a “reversion clause” because it states that ownership of the beaches could revert to ENSC (or its assignee) if:
    A. POENB Inc. fails to maintain the properties, or
    B. The properties stop being used for recreation, or
    C. Any lot or landowner in the POENB Area is not allowed to use the beaches for recreation, in common (“shared”) with others in the area.

Because the indenture agreement was written in 1960 and proper legal paperwork was not filed to extend the clause within the required statutory time period, the first two of the “special limitations (“A” and “B”) NO LONGER APPLY. They are extinguished.

However, the third clause (“C”) is an easement which is still valid. It HAS NOT BEEN and CANNOT BE extinguished.

An easement is a permanent right allowing one landowner (the dominant estate) limited rights to use a portion of the property of another landowner (the subservient estate).

In the POENB Area, all Property Owners are the “dominant estate” while POENB, Inc. the legal owner of the two Beach Properties (Price’s Bend and Valley Grove) is the “subservient” estate.

The third clause “C” (above) is a private, limited, express, appurtenant, affirmative easement (“the Easement”). This Easement applies to all 403 property owners in the POENB Area. The easement does NOT apply to renters of properties in the POENB Area.

To be clear, all Property Owners in the POENB Area have this Easement Right regardless of their membership in POENB, Inc.

The Easement allows Resident Non-(POENB) Member Property Owners (“RNMPOs”) to access and use POENB’s two beaches (at Price’s Bend and Valley Grove) for bathing, boating and recreation (as permitted under POENB’s Beach Rules) without becoming member of POENB, Inc.

These generically described, permitted activities (e.g., bathing, boating and recreation), are identical to the generic activities enjoyed by Members.

However, given that the Easement is a private, limited, express, appurtenant, affirmative easement, the subservient estate (POENB, Inc.) may set certain conditions on how the “dominant estate” (properties owners in the POENB Area) may access and use the two Beach Properties.

See Easement Rules (one of POENB’s collection of seven Rules and Policies) for details on (1) easements in general, (2) POENB’s Easement, (3) Resident Non-Member Property Owner’s Easement Access and Usage Rights and (4) specific restrictions, limitations, and conditions. POENB is legally permitted to and has imposed on the Access and Use of the two Beach Properties by RNMPOs.

  1. Easement Holder – An easement is a permanent right allowing one landowner (the dominant estate) limited rights to use a portion of the property of another landowner (the subservient estate) under certain restrictions, limitations and conditions.
    With respect to the 1960 Indenture Agreement between Eaton’s Neck Sound Corporation (ENSC) and POENB, Inc., POENB is the subservient estate while every one of the owners of 403 single family, residential property lots in the POENB Area are the dominant estate.
    The dominant estate (property lot owners) is also known as “Easement Holders.”
    Again, an Easement Holder does not own nor have title to the land (owned by the subservient estate – POENB, Inc.) but does have limited access and usage rights to the POENB beach properties.
    While all 403 property owners of residential, single family lots in the POENB Area are “Easement Holders,” some have elected to become POENB Members while others have not.
    The subset of property owners who have been granted Easement Rights in the 1960 Indenture Agreement who have opted NOT to voluntarily join POENB, are referred to through the POENB Rules and Policies as “Resident Non-Member Property Owners” or RNMPOs.
  2. Eaton’s Neck Sound Corporation (“ENSC”) – ENSC was a company formed by Robert Lennox. In 1953, the ENSC bought the land defined as the “POENB Area” from Rosalie Gardiner Jones for $360,000 to create a suburban single-family development (Declaration, October 26, 1955 – Liber 4004, Page 483 as filed in the Suffolk County Clerk’s Office in Riverhead, NY).
    Rosalie (1883-1978) inherited the large track of land in Eaton’s Neck (including the POENB Area) from her multi-millionaire mother Mary E. Jones (1883-1978). Interestingly, the POENB Area, under the ENSC, was a Homeowner’s Association (HOA) from October 7, 1955 to October 26, 1980.
  3. Eligible Resident – is an individual who owns or rents property in the POENB Area and, therefore, is “eligible” or has the option of joining POENB, Inc. An Eligible Resident is also called a POENB Area Resident.
  4. Footpath – is another name for a pedestrian path or a means to ingress and egress by foot onto the POENB Beach Properties.
  5. Guest – is an individual who is not eligible to be a POENB member because (he/she does not own or rent property in the POENB Area) but has been invited by a POENB Member (Full or Limited) in Good Standing to join the Member for bathing, boating and recreational activities at one of POENB’s two beach properties. Guests must always abide by the POENB Beach Rules and other relevant POENB Rules and Policies. The definition of a Guest specifically excludes an Eligible Resident (property owner or renter) who has voluntarily chosen NOT to be a member of POENB.
    See Beach Rules – Beach Usage – Guests for detail on the number of Guests a Member may bring to the Beach Properties on a single day and the total number of Guests a Member may bring to the Beach Properties during the POENB membership term (i.e., April 1 to March 31).
  6. Membership Application – is an online or paper form that an Eligible Resident completes to join POENB. The Membership Application asks for (1) a prospective member’s name, address and contact information, (2) the type of membership requested (full or limited and special class or standard), (3) whether a Clicker or watercraft storage is requested, and (4) whether the prospective member has an interest in becoming more involved in POENB (committees).
    The Application also provides a price and fee schedule and allows a prospective member to make voluntary contributions – discretionary or non-discretionary (for a specific event or purpose).
    Finally, the Application requests that a prospective member check a box to confirm that he/she has read, understands, and agrees to comply with POENB Rules and Policies (e.g., Beach Rules, Beach Party / Event Rules, Watercraft Rules (as appropriate), Gate Rules (as appropriate), and Security and Data Policies).
  7. Membership Unit – is a property lot located within the POENB Area. It is not based on the size of the lot nor is it based on the value of the property. One lot = one unit of membership (for a full member/property owner). However, since a property lot cannot vote or enjoy the beach facilities, the Owner(s) or Renter(s) of the property lot must designate a single individual to be the “Member” of POENB. See additional details under “Member.”
  8. Member / Host – a Member who has received approval from POENB to host a Beach Party/Event at POENB’s Price’s Bend Beach Property.
  9. Member – as defined in Article III of the POENB by-laws, is a property owner or renter of one or more of the 403 residential property lots in the POENB Area who has voluntarily elected to join POENB by completing an application form and paying annual membership dues and other selected fees in full and on time.
    A. Full Member – is a POENB member who owns property in the POENB Area. Full members may vote and serve on the POENB Board. Full members have access to all parts of both POENB beach properties and all member amenities that are included in the annual membership.
    B. Limited Member – is a POENB member who rents property in the POENB Area. Limited members can neither vote nor serve on the POENB Board but has full access to both POENB Beach Properties and Member Amenities.
    C. Member in Good Standing – a Full or Limited POENB member who has paid their membership dues and fees and has no other assessments against them – as described in Article XVIII of the POENB By-laws
    D. Designated Member – is the “member of record” for POENB governance and administrative purposes, if the property is jointly owned. The designated member (1) determines how their member vote will be cast (governance – since there is no vote splitting) and (2) identifies the names and number of persons in their “Member Household” (or “Household”).
    E. Member Household – are individuals who (1) live/reside at the same address as the Designated Member and (2) are connected to the Designated Member through blood, marriage, and/or other legal, financial, emotional, and social ties.
    All individuals in the Designated Member’s household enjoy the same access and usage rights to the two POENB Beach Properties as the Designated Member.
    F. De facto Member – is an individual, typically a grandparent, aunt, uncle, professional or informal care giver, babysitter, and nanny/au pair, who is granted “de facto” Member status when he/she accompanies the children (under the age of 15) or the adult care recipient of the Designated Member to the two Beach Properties.
    This de facto member status is valid only during the time that the “care giver” is at the Beach Property with the children or adult care recipient of the POENB Member. When the care giver leaves the POENB Beach Properties with the Member’s children or an adult requiring care who is part of the Member’s Household, the de factor membership status is terminated.
    De facto Members must abide by all POENB Rules and Policies as if they were a Member.
    Granting caregivers de facto membership is an operational convenience for Members. It provides a structured way for a hired / family helper to supervise selected individuals in the Household (children and older adults) to use beaches without relying on Member presence.
  10. Member Entitlements – Members in Good Standing and their Household are entitled to
    A. Access and use of all Member Amenities and Facilities at the two POENB Beach Properties (Price’s Bend and Valley Grove), subject to relevant Beach Rules, Watercraft Rules (if applicable), Gate Rules (if applicable) and Security and Data Rules.
    B. Have a voice (via Board membership and Key Issue Voting -if a full member and as defined in the By-Laws Article III, Section 2, Paragraph c, sub-section c) in the governance and priorities and operations of POENB, Inc. and the management of POENB’s Beach Properties
    C. Attend and participate in monthly membership meetings.
    D. Attend POENB sponsored events.
    E. Request approval to host a Beach Party/Event at Price’s Bend ONLY, subject to POENB Beach Party/Event Rules and other Rules and Policies, as applicable.
    F. Request storage for approved watercraft, subject to availability, in accordance with the Watercraft Rules and provision of a storage fee payment.
    G. Request a Clicker to drive a vehicle through the Security Gate at Price’s Bend and park the vehicle in the parking lot – in accordance with the Gate Policies and payment of a one-time security deposit.
    H. Receive the Changing Tides Newsletter, published 10 times per year, delivered to your mailbox.
    I. Engage with government and corporate officials on relevant community issues (at the Board’s discretion) Note: the number of POENB members acts as a “force multiplier” on public safety and security issues.
  11. Membership Database – is an excel spreadsheet that identifies the name, address, and contract details, type of membership (special or standard), payment method used (paper check or electronic), Clicker ID and Watercraft storage spot (as applicable). It may also identify whether the Member is new (joined in the current year) or is a long tenured Member (since year). The membership database is maintained by the Membership Chair and frequently used by the Treasurer and the Board Member overseeing Watercraft Storage.
  12. Membership Term – POENB’s 12-month membership period runs from April 1 to March 31. Eligible POENB residents may apply for membership in early February, shortly after the annual budget is passed. However, eligible residents may also join anytime during the year. Per the By-Laws Article V – dues are due by March 1 for the following year to be a member in good standing.
  13. Member Meeting – Per the By-Laws Article VIII, member meetings include (1) the annual meeting held in December to elect Board members, (2) regular meetings – conducted monthly to conduct routine Association business, and (3) Special meetings called by the president or the Board or 10 voting members (full) in good standing to introduce, discuss and/or resolve a specific issue. In the collection of seven POENB Rules and Policies, a Member Meeting refers to a regular, monthly meeting, unless otherwise noted.
  14. Optional Member Beach Amenities – There are three (3) amenities that are not included in the annual dues but are available for an extra charge.
    A. Watercraft storage for approved watercraft, subject to storage availability, adherence to the Watercraft Rules (Separate Document), and payment of a separate annual watercraft storage fee. The fee is based on the type and size of the watercraft.
    B. Vehicle access to Price’s Bend via the Security Gate and parking in the Price’s Bend parking lot. See Gate Rules for further details. Access is provided using a “Clicker” to raise and lower the security gate and is available for a one-time security deposit. The clicker is “ever green” – meaning it is permanently assigned to a Member until the Eligible Resident decides not to renew their membership or the “Clicker” no longer functions (because of age, maltreatment or other reasons). The security deposit is returned when the Member returns the “clicker” in good working order, and
    C. Renting out the beaches for private parties. The beach usage fees and party operations rules are outlined in the Beach Party/Event Rules.

Taking advantage of these three additional amenities is entirely optional; purchasing these items is not a condition of membership.

  1. Party / Event Vendor – a Party / Event Vendor may be a POENB Authorized Vendor or it may be a third-party vendor hired by the Member/Host for a Beach Party / Event at POENB Price’s Bend Beach Property.
    A Party/Event Vendors may be a DJ, a caterer, or event tent service provider. These vendors are hired and paid for by the Member / Host. Party/Event Vendors must complete Vendor Agreement for Beach Parties/Events and abide by POENB Rules and Policies. The Member / Host is fully responsible for ensuring Party/Event Vendors complete the form and comply with the terms and conditions in the Vendor Agreement for Beach Parties/Events.
  2. Pedestrian Path – are used to ingress to and egress from the POENB Beach Properties on foot (by walking). Throughout the Rules and Policies, these pedestrian paths may also be called footpaths. There are three pedestrian paths at Price’s Bend, two for Members and one for RNMPOs. There is one pedestrian path at Valley Grove for both Members and RNMPOs.
  3. POENB Area – as specified in the POENB by-Laws, Article II – Purpose, is a defined geographic region in the hamlet of Eaton’s Neck in the Town of Huntington in Suffolk County in NY State. The Area consists of 409 separate lots of land. Four hundred three (403) of the 409 lots are zoned for residential, single-family homes.
  4. POENB Area Resident -is a person (or legal entity) that owns or rents a property lot within the POENB Area. Also called an Eligible Resident.
  5. POENB Beach Storage System – the operational system that POENB’s Board has designed and is executing for Members to safely and fairly store their Watercraft at the two Beach Properties.
  6. POENB Board – or see Board of Directors
  7. POENB, Inc. – is the Property Owners of Eaton’s Neck Beach, Inc. POENB, Inc. also called POENB or “the Association,” is a not-for-profit Corporation organized under the Membership Corporation Law of NYS on March 25, 1960.
  8. POENB Membership Application – is a form, available on paper and online, that eligible POENB Residents are invited to complete and send to the Board of Directors to signify their intention of becoming a POENB Member. The form asks a potential member to provide their first and last name, street address, city, state and zip code, phone number, primarily email address, and secondary email address. It also asks the potential member to identify whether he/she (1) is a special class member, (2) would like a Watercraft spot or spots (max two), (3) would like a Clicker for vehicle access to Price’s Bend, (4) would like to make a voluntary donation (for 4th of July or general / Board discretionary donation) and (5) has read and agrees to abide by the POENB Rules and Policies (as posted on line). The Membership Application also identifies the price of membership (by Member Class – standard or special) as well as additional fees charged for watercraft storage and a one-time Security Deposit for a Clicker. Finally, the Membership Application identifies volunteer opportunities at POENB and acceptable methods of payment.
  9. POENB Rules and Policies – also called “Rules and Policies,” are a set of seven, detailed, topic focused documents that have been adopted by POENB’s Board of Directors to establish clear behavioral expectations and minimize risks. These seven documents, in alphabetical order, are: (1) Beach Rules, (2) Beach Party / Event Rules, (3) Easement Rules, (4) Gate Rules, (5) Key Terms and Definitions, (6) Security and Data Policy and (7) Watercraft Rules.
    These documents are related to and support a larger set of POENB governance and legal documents including (1) By-laws, (2) Articles of Incorporation, and (3) Property Deeds/Indenture Agreements.
  10. Resident Non-Member Property Owners (RNMPOs) – are the owners of properties within the POENB Area who have been granted Easement Rights to the POENB Beaches and have decided not to become POENB members.
  11. Resident Non-Member Property Owner Household – refers to the are individuals who

A. Live/reside at the same address as the RNMPO and
B. Are connected to the RNMPO through blood, marriage, and/or other legal, financial, emotional, and social ties.
All individuals in the RNMPO’s Household enjoy the same access and usage rights to the two POENB Beach Properties as the RNMPO.
However, unlike Members, no other individuals are permitted access to and use of the Beach Properties (e.g., grandparents, aunts, uncles, caregivers, friends, or guests, etc.) under the restrictions, limitations and conditions outlined in the Easement Rules.

  1. Resident Non-Member Property Owner Beach Easement Rights – (RNMPOBER ) while the Easement provides Resident Non-Member Property Owners with the same generic rights to the two Beach Properties, in practice, Member and Resident-Non-Member Property Owner Access and Usage Rights are NOT identical.
    These Easement Rights apply only to the Property Owner in the POENB Area and his/her Household. Easement Rights do not extend to “grandparents, aunts, uncles, friends, or guests” (generally or informally defined) of the RNMPO.
    Briefly, the Easement Right provides Resident Non-Member Property Owners (RNMPO) with limited access to and use of the two POENB Beach Properties.

A RNMPO may enter and exit the beaches solely via the designated pedestrian footpath (marked with signage).

Once on the beach property, RNMPO may engage in basic recreational activity (bathing and boating) exclusively in the Designated Easement Usage (Beach and Water) Area.

Easement Access excludes the use of all Member-funded Amenities, equipment and facilities. RNMPOs may not access or use: parking lot, picnic tables, toilet facilities, shed, barbecue/grills, dinghy/kayak racks, garbage dumpster, swing set, or any other Member-funded facility or amenity. All raked and landscaped areas are “off limits” to RNMPOs.
RNMPOs must:
• Enter and exit promptly after use (no lingering beyond reasonable time for recreation)
• Carry all personal items/gear in by hand (no vehicles or carts).
• Not store any personal items or equipment at the beach
• Must remove all personal items – including garbage at the end of the day.
• May not build, buy or erect any amenities themselves for use in the designated area.
• Must comply with all general beach rules (e.g., hours, behavior, cleanliness) and leave no trace.
• Display proof of qualifying ownership upon request (e.g., deed or tax record).
RNMPO violating these conditions may be redirected by Members or Board representatives to the Designated Easement Usage Area and reported for potential enforcement.
For additional detail, please see POENB’s “Easement Rules” posted on POENB’s website that describes (1) the Easement, (2) POENB Area Property Owners covered by the Easement, (3) the method and location the Resident Non-Members can enter/access the beaches, (4) the specific area of the beach which is designated for resident non-members, (5) the specific conditions placed on Resident non-member property owner’s while they use the beach.

  1. Security Gate – In 20025, POENB installed a security gate using funds entirely donated by members and friends of POENB. The gate, a FAAC B680H Hybrid/Hydraulic Barrier Gate Operator with a barrier arm, was erected at the driveway entrance to Price’s Bend. Members in good standing can open and close this gate to access the Price’s Bend parking lot – after paying a one-time security deposit. The gate can also be opened and closed manually using a key. The key is held by POENB’s Security Officers and authorized Board Members. Please see the Gate Rules for more information on the gate, its operations and usage rules.
  2. Security Officer – is a member of a special POENB Security Committee. Like other Committees, Security Officers are Full Members and are charged with overseeing and ensuring the smooth operation of the Security gate at Price’s Bend. They track and distribute the Clickers to Members, interface with IAL the security gate vendor on maintenance and other matters, hold the manual “override” key, review the surveillance tapes as required, and identify opportunities to improve beach security. They typically interact closely with the Treasurer and Board Members who oversee Watercraft, Beach Maintenance, and Social Events.
  3. Trespasser – in New York State is a person who knowingly enters or remains unlawfully in or upon private real property (i.e., land, structure, watercraft) without the owner’s permission.
  4. Visitor – A visitor is a non-member (RNMPO or Non-POENB Area Resident) who attends a POENB sponsored event that is open to the public. (e.g., Easter Egg Hunt or 4th of July Parade).
  5. Watercraft, also sometimes called “craft,” is abroad, generic term used to describe any vessel or vehicle designed to travel on or above the water. Watercraft could be powered by humans (hands, arms, legs, or feet) with the help of oars and wind or by a motor. Watercraft may include dinghies, shells, kayaks, paddleboards, paddle boats, boats, canoes, rafts, row boats, sail boats, skidoos or jet skis.
  6. Watercraft Decal – a decal (or sticker) given to a Member who has an Assigned Watercraft Storage Spot. The Member must affix the decal to their Approved Watercraft in a prominent, easily identifiable location so that the Board and other Members can immediately see that the stored watercraft belongs to a current POENB Member in Good Standing.
  7. Watercraft Rack Spot / Sail Craft Beach Spot – also sometimes called a “watercraft storage spot” refers to the two general categories of watercraft storage offered by POENB: watercraft racks and designated beach spots.
  8. Watercraft Spot Assignment Day” – refers to a particular date, set every two years by the Board, held at the Eaton’s Neck Firehouse, to fairly allocate Watercraft Rack Spots and Sail Craft Beach Spots. “Assignment Day” typically occurs in the month of April.
  9. Watercraft Storage Fees – refers to the annual fee that POENB charges a POENB Member for storing their Watercraft or Sail Craft at the POENB Beach Properties.
